Acceptable Use Policy (AUP)

Mountain Tower and Network Company, LLC., hereinafter referred to as ShastaBeam strives to provide its customers with the highest quality Internet service that is available and at the same time respect the standards that have been created within the Internet community.  ShastaBeam states that certain activities and conduct are inappropriate or abusive and will not be tolerated. The activities listed below is not meant to be exhaustive, but merely illustrative of examples of conduct deemed by ShastaBeam to be inappropriate and improper and therefore prohibited.

ShastaBeam‘s network may only be used for lawful purposes. The transmission of material that is in violation of any federal, state or local law, or that is protected by trademark, trade secret or other intellectual property is strictly prohibited.

Customers are prohibited from using the ShastaBeam’s network to transmit material that is judged by ShastaBeam to be illegal, proprietary, obscene, criminal or in some fashion inconsistent with the generally accepted standards of the Internet community.

ShastaBeam has zero tolerance for the use of its network by anyone for the distribution of unsolicited bulk commercial e-mail transmissions.

ShastaBeam may meter bandwidth usage of its customers. We offer limited & unlimited bandwidth usage in most of our service packages, but reserve the right to cancel service of any customer whose usage is determined to be excessive at the sole discretion of ShastaBeam.  ShastaBeam’s Beacon service is provided by third party carriers and may be suspended, slowed down, or terminated at any time at the sole descretion of the carrier. 

ShastaBeam also has zero tolerance for the use of its network for the posting of messages or commercial advertisements which violate the rules, regulations, FAQ, or charter of any newsgroup or mailing list. Commercial messages that are appropriate under the rules of a newsgroup or mailing list or that are solicited by the recipients are permitted unless found to be excessive or inappropriate at the discretion of Shastabeam.

ShastaBeam reserves the right to cancel or alter services of any customer who has been found to create problems with the use of the ShastaBeam network that affects other ShastaBeam customers.

Anyone who publishes materials and information which are accessible through ShastaBeam’s network is solely responsible for the content of such materials and information and is solely responsible to know and comply with all laws applicable to the publication and distribution of such materials and information. ShastaBeam does not accept responsibility for the content of the materials and information published by others which is accessible through the Shastabeam network and does not accept responsibility for the violation of any laws resulting from such publication or distribution.

Shastabeam is an access provider and as such exercises no control over the content of the information passing through its network. It is expected that Shastabeam‘s customers will comply with whatever rules or Acceptable Use Policies that are appropriate for those networks accessed through Shastabeam. Each Shastabeam customer accepts the responsibility to avoid whatever material it finds offensive. If any Shastabeam customer interferes with others’s use and enjoyment of the services provided by Shastabeam, such customer shall be deemed to be in violation of this AUP.

Business customers of Shastabeam must ensure that its own customers do not act in a way that violates Shastabeam‘s AUP.  Shastabeam business customers are expected to bring their customers into compliance with Shastabeam‘s AUP or risk their service being discontinued.

Shastabeam is solely responsible for determining if a violation of the AUP has occurred.  Even though Shastabeam does not review or censor materials and information which is accessible on Shastabeam‘s network or other networks which may be connected to Shastabeam‘s network, if Shastabeam becomes aware that one of its customers is in violation of this AUP, Shastabeam reserves the right to suspend or terminate service without notice. In addition, Shastabeam reserves the right to interpret this AUP in its sole discretion and to amend, revise, add or delete any provision of this AUP.  This AUP shall supercede any prior policies of ShastaBeam.
